Abba Kyari, the currently suspended deputy police commissioner, appealed, but the Abuja Court of Appeal dismissed.
The federal high court in Abuja denied his release and the appeal sought to overturn that decision.
Judge Stephen Adah, who read the unanimous decision of the three-man panel, argued that Kyari’s appeal was unfounded and that these bail applications should be treated with caution due to the nature of the charges—pending charges against Kyari and others in the trial court.
He found that Judge Emeka Nwite of the Federal Supreme Court in Abuja, who had previously refused to bail Abba Kyari, had done his due diligence by denying Kyari bail.
Kyari, the former head of the Nigerian Police Intelligence Response Team is facing prosecution by the National Drug Enforcement Agency. He and four IRT members – ACP Sunday J. Ubua, ASP Bawa James, Inspector Simon Agirgba, and Inspector John Nuhu were charged in the Federal Supreme Court in Abuja with conspiracy to sell 17.55 kg of cocaine.
They were also charged with trafficking cocaine without legal authorization; conspiracy to forge cocaine and illegally tampering with 21.35 kg of cocaine seized from two convicted drug traffickers.
