A Federal Supreme Court, Abuja, has set May 31 to rule on Governor Nyesom Wike de Rivers’ complaint asking for an order to prevent the People’s Democratic Party (PDP) from evicting him from the party.
Judge James Omotosho fixed the date Monday after advising the Governor, Dr. Joshua Musa, SAN, and PDP attorney Johnson Usman, SAN, who approved their proceedings and presented their arguments in favor and against the lawsuit.
NAN reports that Wike has sued the PDP, the National Working Committee (NWC), and the National Executive Committee (NEC) as first and third defendants respectively.
The Governor, in costume, marked:
FHC/ABJ/CS/139/2023, also joined by PDP Country President, Dr. Iyorchia Ayu; DPP National Secretary Senator Samuel Anyanwu and the Independent National Electoral Commission (INEC) were the 4th to 6th responders respectively. Wike is seeking an order directing all parties to maintain the status quo and stop all actions regarding threats to suspend or deport him by the 1st through 5th Defendants pending trial. and court decisions at the original request.
NAN reported that Judge Omotosho, on February 2 issued a temporary order against the party and other listed individuals against Wike’s February 2 lawsuit.
Judge, who extended the restraining order on February 2. 14, argues that all parties should maintain the status quo pending the hearing and decision on the case.
As the hearing continued on Monday, Musa informed the court that the case had been adjourned for trial and that he was ready to proceed.
He said his client’s basic freedom of association had been violated because respondents threatened to suspend him and then expel him from the party, thus requiring a trial.
But in response, Usman, who represented the PDP and others, disagreed with Musa’s submission.
He argued that the case was based on speculation because Wike presented no evidence that the defendants intended to suspend or expel him from the party. He said the party has not considered suspending or expelling any members of the G5 governors or integrity groups.
