INEC, acclaimed president-elect Bola Tinubu, and his party, All Progressive Congress, APC, are named as defendants in the lawsuit.
Both claims are based on section 146(1) of the Elections Act 2022, subsections 47(1,2 and 3) of the First Schedule of the Elections Act 2022, as well as the inherent jurisdiction of the Court. , as mentioned in Section 6 (6) A & B of the 1999 Constitution, as amended. They argued that the documents requested would help with their lawsuit against the outcome of the declared presidential run in favor of the APC candidate, Tinubu.
INEC declared APC’s Tinubu the winner of the presidential election, ahead of 17 other candidates running for office.
According to INEC, Tinubu received a total of 8,794,726 votes to beat Atiku, who collected a total of 6,984,520 votes, and Obi from LP, who came in third with a total of 6,101,533 votes. Since then, the PDP and LP have rejected the election result and promised to challenge it in court.
